Terms of Service Welcome to Afripedia!
The following terms and conditions ("Terms") govern your use of the Afripedia website and platform, located at www.afripedia.com, and your use of any and all products, computer programs, applications, widgets, services, platforms, integrations and web sites hosted or made available by Afripedia, as well as any images, illustrations, photographs, graphics, logos, audio, video, music, text, user comments, messages, information, data, articles and any other content displayed on or accessed through the Afripedia platform, regardless of whether accessed through the Afripedia website or a third-party platform (collectively, the "Service" or "Services"). These Terms govern all your use of Afripedias products, features, services, and software we offer except where we expressly state that separate terms (and not these) apply.
These Terms create a legal contract between you and Afripedia regarding your use of the Services. Throughout these Terms, "Afripedia" "us" "our" and "we" refers to [AFRIPEDIA LEGAL ENTITY] and its affiliates; and "you", “Member” or "User" refers to you, our user — anyone who uses, joins, visits, subscribes to or otherwise accesses Afripedia and its Services.
1. Our Service Afripedia is an online service that enables Members to create, organize, share and discover content of our Members through the Service, Members may bookmark digital images and assemble collections, as well as follow and interact with other Members.
1.1. Research ways to make our services better:
We engage in research and collaborate with others to improve our Product. One way we do this is by analyzing the data we have and understanding how people use our Product.
1.2. Enable global access to our services:
To operate our global service, we need to store and distribute content and data in our data centers and systems around the world, including outside your country of residence. This infrastructure is operated or controlled by Afripedia or its affiliates.

Your commitments to Afripedia
We provide these Services to You and others to help advance our mission. In exchange, we need You to make the following commitments:
3.1. Who can use Afripedia
When people stand behind their profile, our community is safer and more accountable. For that reason, you must:
Use the same name that you use in everyday life.
Provide accurate information about yourself.
Create only one account.
Not share your password, give access to your Afripedia account to others, or transfer your account to anyone else (without our permission).
We try to make Afripedia broadly available to everyone, but you cannot use Afripedia if:
You are under 16 years old.
We previously disabled your account for violations of our terms or policies.
You are solely responsible for the activity that occurs in your account. By connecting Afripedia with a third-party service, you give us permission to access and use your information from that service as permitted by that service (e.g., Facebook, Instagram and Twitter). You are also responsible for maintaining the security of your account password, as well as the passwords of any third-party services that you may have elected to link to your account.
You agree to notify Afripedia immediately of any breach of security or unauthorized use of your account. You may be liable for the losses of Afripedia or others due to such unauthorized use or any other use in violation of these Terms. Afripedia reserves the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames.
You are solely responsible for your interactions with other Users. We reserve the right, but have no obligation, to monitor disputes between you and other Users that may arise. Afripedia will not be liable for your interactions with other Users, or for any User’s action or inaction.
3.2. What you can share and do on Afripedia We want Members to use Afripedia to create, organize, share and discover content of our Members through the Service, Users may bookmark digital images and assemble collections, as well as follow and interact with other users, but not at the expense of the safety and well-being of others or the integrity of our community. You therefore agree not to engage in the conduct described below (or to facilitate or support others in doing so):
You may not use our Product to do or share anything:
That is unlawful, misleading, discriminatory or fraudulent.
That infringes or violates someone else's rights. This also includes property rights. You the Member must therefor represent and warrant to us that the underlying intellectual property rights to the material you post, display, transmit or otherwise make available on Afripedia, including but not limited to copyrights, are owned by the you, the Member who has posted the material.
You may not upload viruses or malicious code or do anything that could disable, overburden, or impair the proper working or appearance of our Product.
You may not access or collect data from our Product using automated means (without our prior permission) or attempt to access data you do not have permission to access.
We can remove content you share in violation of these provisions and, if applicable, we may take action against your account, for the reasons described below. We may also disable your account if you repeatedly infringe other people's intellectual property rights.
Where appropriate, we will take steps to notify you when we remove your content for violating our community standards. We may not be able to provide notice in all cases, for example if we are prohibited from doing so by law or where it might harm our community or the integrity of our Product.
To help support our community, we encourage you to report content or conduct that you believe violates your rights (including intellectual property rights) or our terms and policies.
3.3. The permissions you give us
We need certain permissions from you to provide our services:
Permission to use content you create and share: You own the content you create and share on Afripedia, and nothing in these Terms takes away the rights you have to your own content. You are free to share your content with anyone else, wherever you want. To provide our Services, though, we need you to give us some legal permissions to use that content.
Specifically, when you upload content that is covered by intellectual property rights (like photos), you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, run, copy, publicly perform or display, translate, and create derivative works of your content. This means, for example, that if you share a photo on Afripedia, you give us permission to store, copy, and share it with others such as service providers that support our Service. Additionally, to the extent permissible under the laws of your state, jurisdiction or country, you hereby waive any right of droit moral or any similar right with respect to the User Content and agree not to institute, support or maintain any action or lawsuit on the ground that the exercise of any of the rights conveyed by you under these Terms constitutes an infringement of any right of droit moral or any similar right is in any way a defamation or mutilation of the User Content, or any part thereof, or of the reputation of any artist, or contains unauthorized variations, alterations, modifications, changes or translations
You can end this license any time by deleting your content or account. You should know that, for technical reasons, content you delete may persist for a limited period of time in backup copies (though it will not be visible to other users).
Permission to update software you use or download: If you download or use our software, you give us permission to download and install upgrades, updates, and additional features to improve, enhance, and further develop it.
3.4. Limits on using our intellectual property If you use content covered by intellectual property rights that we have and make available in our Product (for example, images, designs, videos, or sounds we provide and all related technology, materials, data, tools, widgets, user activity reports, intellectual property, programming, development and design, including but not limited to the front and backend systems, visual design, Internet website and accompanying databases), we retain all rights to that content. Notwithstanding material posted or uploaded by our Users, all of the content on the Service, including without limitation, the Afripedia logo, and all designs, text, graphics, pictures, selection, coordination, 'look and feel', information, data, software, sound files, other files and the selection and arrangement thereof (collectively, the "Site Materials"), are owned by or licensed to Afripedia. We protect our Site Materials to the fullest extent permissible under international trade dress, copyright, patent and trademark laws, and various other intellectual property and unfair competition laws. This Agreement does not transfer any ownership rights in any of the foregoing to you or any third party. Afripedia is owned by [AFRIPEDIA LEGAL ENTITY], and may not be copied, imitated or used, in whole or in part, without the prior written permission of [AFRIPEDIA LEGAL ENTITY]. You may not use any metatags or any other "hidden text" utilizing "Afripedia" or any other name, trademark or product or service name of "Afripedia" without our prior written permission. Content on the website is provided to you on an "as is" basis for your information and personal use only and may not be copied, reproduced, distributed, transmitted, displayed, publicly performed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective rights holders. All other trademarks, registered trademarks, product names and names or logos mentioned in the Service are the property of their respective owners.
4. Additional provisions
4.1. Updating our Terms
We work constantly to improve our services and develop new features to make our Product better for you and our community. As a result, we may need to update these Terms from time to time to accurately reflect our services and practices. Unless otherwise required by law, we will notify you (for example, by email or through our Product) at least 30 days before we make changes to these Terms and give you an opportunity to review them before they go into effect. Once any updated Terms are in effect, you will be bound by them if you continue to use our Product.
We hope that you will continue using our Product, but if you do not agree to our updated Terms and no longer want to be a part of the Afripedia community, you can delete your account at any time.
4.2. Account suspension or termination
We want Afripedia to be a place where people feel welcome and safe.
If we determine that you have clearly, seriously, or repeatedly violated our terms or policies, we may suspend or permanently disable access to your account. We may also suspend or disable your account if we required to do so by law. Where appropriate, we will notify you about your account the next time you try to access it.
If you delete or we disable your account, these Terms shall terminate as an agreement between you and us, but the following provisions will remain in place: 3, 4.2-4.5
4.3. Limits on liability We will use reasonable skill and care in providing our Product to you and in keeping a safe, secure, and error-free environment, but we cannot guarantee that our Product will always function without disruptions, delays, or imperfections. Provided we have acted with reasonable skill and care, we do not accept responsibility for: losses not caused by our breach of these Terms or otherwise by our acts; losses which are not reasonably foreseeable by you and us at the time of entering into these Terms; any offensive, inappropriate, obscene, unlawful, or otherwise objectionable content posted by others that you may encounter on our Product; and events beyond our reasonable control. You agree to indemnify and hold [AFRIPEDIA LEGAL ENTITY] and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claims, losses, damages and expenses, including court costs and reasonable attorney’s fees, made by any third party due to or arising out of links you submit, post, transmit or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the Terms of Service, or your violation of any rights of another party.
The above does not exclude or limit our liability for any things where the law does not permit us to do so.
We try to provide clear rules so that we can limit or hopefully avoid disputes between you and us. If a dispute does arise, however, it's useful to know up front where it can be resolved and what laws will apply.
If you are a consumer and habitually reside in a Member State of the European Union, the laws of that Member State will apply to any claim, cause of action, or dispute you have against us that arises out of or relates to these Terms and you may resolve your claim in any competent court in that Member State that has jurisdiction over the claim. In all other cases, you agree that the claim must be resolved in a competent court in Sweden and that Swedish law will govern these Terms and any claim, without regard to conflict of law provisions.
These Terms make up the entire agreement between you and Afripedia regarding your use of our Product. They supersede any prior agreements.
If any portion of these Terms are found to be unenforceable, the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, it will not be considered a waiver. Any amendment to or waiver of these Terms must be made in writing and signed by us.
You will not transfer any of your rights or obligations under these Terms to anyone else without our consent.
These Terms do not confer any third-party beneficiary rights. All of our rights and obligations under these Terms are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
You should know that we may need to change the username for your account in certain circumstances (for example, if someone else claims the username and it appears unrelated to the name you use in everyday life).
We always appreciate your feedback and other suggestions about our product and service. But you should know that we may use them without any restriction or obligation to compensate you, and we are under no obligation to keep them confidential.
We reserve all rights not expressly granted to you.
